1. Agreement

This End User License Agreement ("Agreement") is a legal agreement between you and Intelligent Control Technologies LLC, an Illinois limited liability company, for the WorldClockBar software application, including its data files, assets, and documentation ("Software"). By installing or using the Software, you accept this Agreement. If you obtained the Software through the Microsoft Store, the Microsoft Store Standard Application License Terms also apply; where they conflict with this Agreement, the Microsoft Store terms control for matters they cover, including refunds.

2. License Grant

Subject to your compliance with this Agreement, we grant you a personal, non-exclusive, non-transferable, revocable license to install and use the Software on any device you own or control, for your own personal or internal business purposes. This license is granted, not sold. We and our licensors retain all rights not expressly granted.

3. What You May Not Do

  • -Sell, rent, lease, sublicense, lend, or otherwise distribute the Software to any third party
  • -Reverse engineer, decompile, or disassemble the Software, except to the extent applicable law expressly permits
  • -Modify the Software or create derivative works based on it
  • -Remove, obscure, or alter any copyright, trademark, or attribution notice, including the map data attribution
  • -Circumvent or disable any licensing, security, or access-control feature
  • -Use the Software in violation of any applicable law

4. Ownership

The Software is protected by copyright and other intellectual property laws. We or our licensors own all title, copyright, and other intellectual property rights in the Software. The name "WorldClockBar", our logos, and our product designs are our trademarks or trade dress.

5. Privacy and Your Data

The Software stores your preferences locally on your device. We do not collect, transmit, or receive that information. The Microsoft Store version operates entirely offline: no network connections, no analytics or telemetry, no advertising, and no account. Our Privacy Policy is incorporated into this Agreement by reference.

6. Third-Party Components and Map Data

The Software includes third-party components and data, each subject to its own license. The Software's map data is derived from OpenStreetMap and is provided under the Open Database License (ODbL); the Software displays an OpenStreetMap attribution on its maps, which you may not remove or obscure.

7. Accuracy and Intended Use

The Software displays times, time zones, daylight-saving transitions, geographic data, and astronomical information for general informational and convenience purposes only. Time zone rules change, sometimes with little notice, and clock accuracy depends on your device. The Software is not designed, tested, or licensed for use where inaccurate time or location information could result in death, personal injury, or physical, financial, or environmental damage — including navigation, aviation, medical, emergency-response, industrial-control, financial-trading, or legal-deadline use. Independently verify any information before relying on it for a consequential decision.

8. Updates

Copies obtained from the Microsoft Store are updated through the Microsoft Store. This Agreement applies to updates unless an update carries its own terms. We are not obligated to provide updates, support, or continued availability.

9. Disclaimer of Warranties

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, THE SOFTWARE IS PROVIDED "AS IS" AND "AS AVAILABLE," WITH ALL FAULTS AND WITHOUT WARRANTY OF ANY KIND. WE DISCLAIM ALL WARRANTIES, EXPRESS, IMPLIED, OR STATUTORY, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, ACCURACY, AND NON-INFRINGEMENT.

10. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW: (a) our total cumulative liability will not exceed the amount you actually paid for the Software, or US $5.00 if you paid nothing; (b) we will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages, or for lost profits, revenue, data, business, goodwill, or any missed appointment, deadline, meeting, transportation, or business opportunity; (c) these limits apply to all claims under any legal theory.

11. No Personal Liability

This Agreement is with Intelligent Control Technologies LLC only. To the maximum extent permitted by law, our members, managers, officers, employees, and contractors have no personal liability arising out of or relating to the Software or this Agreement.

12. Your Consumer Rights

Some jurisdictions do not allow certain warranty exclusions or damage limitations; in those jurisdictions the above sections apply only to the extent permitted by law. Nothing in this Agreement excludes liability for fraud, fraudulent misrepresentation, or death or personal injury caused by negligence, or any liability that cannot be excluded under applicable law.

13. Refunds

If you purchased the Software from the Microsoft Store, refunds are handled by Microsoft under the Microsoft Store terms and refund policy. We do not process Store refunds.

14. Term and Termination

This Agreement applies until terminated and terminates automatically if you materially breach it. On termination you must stop using the Software and remove all copies from your devices.

15. Governing Law and Venue

This Agreement is governed by the laws of the State of Illinois, United States, without regard to conflict-of-laws rules. Disputes will be brought exclusively in the state or federal courts located in Lake County, Illinois, except where mandatory consumer law of your country of residence provides otherwise.
